​What Documents Do You Need for a Short Sale in Nevada?

A short sale might be the best option to avoid foreclosure for any Las Vegas homeowner facing financial hardship. But before you can get approval from your lender, there's paperwork. And LOTS of it.

Knowing exactly which documents are needed can save you time, reduce stress, and improve your chances of a successful short sale. Here you will learn: the required short sale documents, why each one matters, and how I can help guide you through the process.

🧾 What Is a Short Sale?

A short sale happens when a homeowner sells their property for less than the amount owed on the mortgage. The lender agrees to accept that amount to settle the debt. It’s a powerful alternative to foreclosure, and in many cases, it’s a win-win for both the lender and the seller.

But first, the lender needs documentation, and A LOT of it, to even consider approving the short sale.

​📋 Step One: Determine the Homeowner’s Equity & Loan Status

Before contacting the lender’s loss mitigation department, the homeowner will need to gather these details:
  • Is the seller currently in bankruptcy? (If so, court and trustee approval is required.)
  • What is the loan balance, interest rate, and loan type?
  • Are there past-due payments or an impound account?
  • Has a Notice of Default (NOD) or Notice of Trustee’s Sale been recorded?
  • Are there additional liens, judgments, or unpaid property taxes?

​This info helps assess whether a short sale is even possible and frames the conversation with the lender.

🏦 Step Two: Documents Needed to Begin Negotiations with the Lender

Once you're ready to approach the lender’s Loss Mitigation Department (sometimes called Foreclosure, Short Sale, Loan Modification, or Reinstatement), be prepared to provide:
  • Authorization to Release Information (must be signed by the borrower)
  • A hardship letter from the seller explaining why they can no longer afford the mortgage
  • Copies of the homeowner’s most recent bank statements, pay stubs, and tax returns (usually two of each)
  • A Broker Price Opinion (BPO) to show current market value
  • A net sheet showing all transaction expenses and what the lender will receive at closing
  • A preliminary title report or title commitment
  • A signed listing agreement
  • A marketing plan showing the home is actively being promoted

​These documents help prove to the lender that the property is being properly marketed, priced fairly, and that the seller is facing real financial hardship.

📝 Step Three: Final Documents Required After Offer Acceptance

Once the lender has agreed to move forward with the short sale, the following needs to be submitted:
  • A signed copy of the complete sales contract
  • A copy of the buyer’s loan application
  • Proof of the buyer’s deposit and escrow receipt
  • An updated HUD or settlement statement
  • A revised preliminary title report, if needed

​Timing is crucial here. The faster these items are submitted, the sooner the deal can close and the sooner the seller can move on.
